SMOKEX ("we", "us", "our") respects your privacy. This policy explains how we collect, use, disclose and protect your personal information when you visit smokex.au, buy from us, or contact us.

We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

What we collect

  • Contact and order details: your name, email address, phone number, shipping address and billing address.
  • Order information: what you bought, order value, order history and delivery status.
  • Payment information: handled by our payment providers. We receive confirmation that a payment succeeded, plus the card type and last four digits. We never see or store your full card number.
  • Account information: if you create an account, your username and password (stored in encrypted form).
  • Age confirmation: your confirmation that you are 18 or over, and any proof of age you provide if we ask for it.
  • Technical information: IP address, browser and device type, pages visited, referring site and similar analytics data.
  • Communications: the content of emails and messages you send us.

How we collect it

Mostly directly from you — when you place an order, create an account, subscribe to our mailing list, or email us. We also collect technical information automatically through cookies and analytics, and we receive information from our service providers, for example our payment processor confirming a transaction or our carrier confirming delivery.

Where it is lawful and practicable you may deal with us anonymously or under a pseudonym, but we cannot ship an order without a name and delivery address.

Why we collect it

  • To process, fulfil and deliver your orders
  • To verify that you are 18 or over
  • To communicate with you about your order, returns and enquiries
  • To process refunds and handle consumer guarantee claims
  • To detect and prevent fraud and misuse of the site
  • To improve our products, website and service
  • To send you marketing, where you have asked to receive it
  • To meet our legal, accounting and tax obligations

Direct marketing

We only send marketing emails to people who have opted in. Every marketing email includes an unsubscribe link, and you can opt out at any time by emailing support@smokex.au. We do not sell or rent your personal information to third parties for their own marketing.

Who we share it with

We disclose personal information only to:

  • Shopify, which hosts our online store and processes orders
  • Payment providers, to take payment and process refunds
  • Carriers and logistics providers, to deliver your order
  • Email and analytics providers, to run our mailing list and understand site usage
  • Professional advisers, such as our accountant, where necessary
  • Law enforcement or regulators, where we are required or authorised by law

We do not sell your personal information.

Overseas disclosure

Some of our service providers, including Shopify and our payment and email providers, store or process data outside Australia. By using our Services you consent to this disclosure. We take reasonable steps to ensure overseas recipients handle your information consistently with the Australian Privacy Principles, but we cannot control the laws of every country in which they operate.

Cookies

We use cookies to keep your cart working, remember your preferences, and measure how the site is used. You can block or delete cookies in your browser settings, but parts of the site may stop working properly if you do.

How long we keep it

We keep order and transaction records for at least seven years, as required by Australian tax law. Marketing subscriber data is kept until you unsubscribe. Other personal information is destroyed or de-identified once we no longer need it for the purpose it was collected and we are not required by law to retain it.

Security

We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure. Our store runs over encrypted connections and payment data is handled by PCI-compliant providers. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Data breaches

If we have reasonable grounds to believe an eligible data breach has occurred, we will notify affected individuals and the Office of the Australian Information Commissioner as required by the Notifiable Data Breaches scheme under Part IIIC of the Privacy Act 1988 (Cth).

Accessing and correcting your information

You may request access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. Email support@smokex.au. We will respond within 30 days. We do not charge for access requests. If we refuse access or correction, we will tell you why in writing.

Complaints

If you believe we have breached the Australian Privacy Principles, email support@smokex.au with the details. We will acknowledge your complaint within two business days and aim to resolve it within 30 days.

If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or on 1300 363 992.

Visitors outside Australia

Our Services are directed at customers in Australia. We do not ship to the European Union or the United Kingdom and we do not target customers there. If you access the site from overseas you do so on your own initiative, and your information will be handled under this policy and Australian law.

Children

Our Services are for adults aged 18 and over. We do not knowingly collect personal information from anyone under 18. If you believe we have, email support@smokex.au and we will delete it.

Changes to this policy

We may update this policy from time to time. We will post the revised version on this page and update the "Last updated" date above.
